The government has suffered a blow today as the EU's highest court ruled that the "general and indiscriminate retention" of emails and electronic communications by governments is illegal.
The Court of Appeal will now determine the case, so it's not quite the end of the road just yet. Brexit too could see the debate rumble on once we step outside of the EU and the European Court of Justice's jurisdiction.
However for now at least, the result has been welcomed by campaigners and members of parliament who suggest the Investigatory Powers Act treats everyone as a suspect and was too widely drafted.
