In a Judgment dated 25 July 2018, the Supreme Court have ruled that Mrs Owens should not be entitled to a divorce and she must effectively remain married to her husband against her will until she has been living apart from him for a period of at least 5 years.
In making this Judgment, the Supreme Court Judges have applied the current law correctly. However, in doing so they highlighted how troubling Mrs Owens’ appeal is, generating “uneasy feelings,” and that they had reached their decision "with reluctance".
Thankfully, reform may now take place with the Ministry of Justice recognising the need for reform and a Private Members Bill to commit the Lord Chancellor to review the current law.
Following the ruling, the Ministry of Justice said: "The current system of divorce creates unnecessary antagonism in an already difficult situation. "We are already looking closely at possible reforms to the system."
